Terms of Use and Protection of Personal Data


ELTRAK S.A., the company having created the website Eltrak.gr in collaboration with HOL, offers its services under the following terms of use that the visitor/user of the pages of the website is called to read carefully and proceed with the visit/use of the pages/services of Eltrak.gr, only if he fully accepts these terms. ELTRAK S.A reserves itself all rights to amend, remove or add terms and conditions at any time. Such modifications may apply at any moment. You are therefore requested to check the terms and conditions for the provision of services regularly.

PREAMBLE 

ELTRAK S.A provides to the visitors/users of the website Eltrak.gr a rich collection of services, pages, choices and/or sources including various communication tools, services of electronic trade. The pages of Eltrak.gr may contain publicity of all forms. The already existing and any new services to be included to the Eltrak.gr are subject to these terms of use, except if the contrary is explicitly expressed. The visitor/user of the services of Eltrak.gr understands and accepts that the whole of the pages/services is provided ‘as it is’ and ELTRAK S.A. does not have any responsibility concerning the limited period, the cancellation, the bad performance or the impossibility for electronic storage of any data of the users and/or any content of personal pages/services.
The visitor/user is responsible for access to the services of Eltrak.gr and the relevant access and the relevant access may ask for the payment of fees to third parties ( e.g. providers of internet services, charge for the time of internet use). The visitor/user as the exclusive responsibility for the payment of the relevant fees and understands that Eltrak. S.A., is not liable to know or show in the website anything concerning rights of third parties from the use of Eltrak.gr. Also, the visitor/user is exclusively responsible for his personal equipment with the necessary technological means allowing him access to the services of Eltrak.gr.

Restrictions of Use

IT IS NOT ALLOWED TO COPY, REPRODUCE, REPUBLISH, MODIFY, CREATE FROM, TRANSFER OR EXPLOIT IN ANY WAY ANY PART OF THE SERVICE PROVIDED, EXCEPT FOR THE DOWNLOADING FROM THE SERVICE AND PRINTING OF ONE COPY EXCLUSIVELY FOR YOUR PERSONAL USE, NOT COMMERCIAL USE, PROVIDED YOU WILL MAINTAIN ALL RIGHTS REFERRALS, CREATION AND OTHER RIGHTS OF PROPERTY.
FURTHERMORE, YOU CANNOT SELL A PART OF THE SERVICE OR DISTRIBUTE IT AT OR WITHOUT EXCHANGE TO ANOTHER MEANS INCLUDING BUT NOT LIMITED TO TELEVISION OR RADIO, NETWORK OF ELECTRONIC COMPUTERS OR BY THE USE OF FRAMES IN THE INTERNET WITHOUT THE PREVIOUS WRITTEN CONSENT OF ELTRAK S.A. THEREFORE, THE SERVICE PROVIDED AND THE DATA CONTAINED IN IT CANNOT BE USED TO MAKE DATA BASES OF ANY KIND. YOU CANNOT USE THE SERVICE IN ANY WAY TO IMPROVE THE QUALITY OF ANY DATA THAT HAVE BEEN SOLD OR FOR WHICH YOU HAVE CONTRACTED WITH THIRD PARTIES.
FURTHERMORE, YOU CANNOT USE ANY OF THE TRADE MARKS, THE TRADE NAMES OR THE TITLES OF SERVICES OF ELTRAK S.A. IN ANY WAY THAT MAY CREATE THE IMPRESSION THAT THE MARKS AND NAMES BELONG TO YOU OR ARE CONNECTED WITH YOU OR THAT THEY ARE USED WITH THE CONSENT OF ELTRAK S.A.

LOSS AND INDEMNITY 

The user/member of Eltrak.gr understands and accepts that he has the exclusive responsibility to indemnify Eltrak.gr and their collaborators for any legal dispute tha may arise between him and third parties due to the content that he will dispose for presentation, publication or other transfer through the services of Eltrak.gr.


BEGINNING-INTERRUPTION OF THE OPERATION OF SERVICES ELTRAK S.A. maintains the right to modify and/or interrupt, provisionally or permanently a part of the whole of its services with or without previous notice to the users/members. 

TERM 

The user/members understands and agrees that ELTRAK S.A. has the exclusive right to interrupt the use of the code/s of access to its service/s and interrupt the provision of the contents thereof to the users/members believed to have violated these terms of use.


PUBLICITY 

ELTRAK S.A. is not responsible for the communication of the user/member with the third parties providers of services advertised in the Eltrak.gr. and any commercial negotiation that may derive from the relation between them.

RIGHT OF INTELLECTUAL AND INDUSTRIAL PROPERTY - MARKS

Except for the expressly mentioned exclusions (intellectual rights of third parties, collaborators and bodies), the whole contents of Eltrak.gr, including pictures, graphics, photos, drawing, texts, services provided and in general all files of this website, are the intellectual property, filed trade marks and marks of ELTRAK S.A. services and are protected by the relevant provisions of the Greek law, the European law and the international conventions. Thus, none of these can be, wholly or partly, the object of sale, copy, modification, reproduction, republication or ‘loaded’, transmitted or distributed in any way. The case of storage of one only copy of a part of the contents in one simple personal computer, for personal and not public or commercial use and without omitting their origin from the Eltrak.gr is excluded and this without violating the relevant rights of intellectual and industrial property. The other products or services mentioned in the electronic pages of this network access system with the marks of the respective organizations, companies, collaborating carriers, unions or editions, are their intellectual and industrial property and consequently these carriers bear the relevant responsibility. The user/member understands that he is not entitled to reproduce, copy, sell, resell and/or commercially exploit in any way the whole or part of the contents of Eltrak.gr.

LIMITS OF RESPONSIBILITY

Given the nature and the volume of the Internet, under any circumstances, the negligence case included, ELTRAK S.A. is not responsible for any kind of loss sustained by the visitor/user of the pages, services, choice and contents of the Eltrak.gr where he has access in his own initiative. The contents of Eltrak.gr are provided ‘exactly as they are’ without any guarantee, explicit and/or inferred in any way. According to the law, ELTRAK S.A. denies all guarantees expressed or implied, including but not limited to those which entail the commerciality and the fitness for a precise object.
Eltrak.gr does not guarantee that the pages, service, choices and contents will be provided without interruption without errors and that the errors will be corrected.ELTRAK S.A does not guarantee that the same or any other relative site or the servers through which these will be at the disposal of the users/members do not contain ‘viruses’ or other harmful components.
ELTRAK S.A. does not guarantee the correctness, the fullness and/or availability of the contents, pages, services, choices or the results thereof. The cost of eventual corrections or services is bourn by the visitor/user and in no case by ELTRAK S.A.

NO RESPONSIBILITY FOR INFORMATION/ADVICE 

The contents and information included in the Eltrak.gr are an offer to the visitor/user of Eltrak.gr and in general to the community of the internet users and in no case they can be understood as valid information and/or advice and in no case they can be considered as concealing a prompt for the undertaking or not of non precise acts. Eltrak.gr is responsible for the collection, process and distribution of its contents and in no case will it guarantee the fullness, sufficiency and in general the appropriateness thereof and the absence of eventual errors, much more due to the particularly big volume thereof as well as the participation of third carriers (individuals or legal entities) in the primary production and collection thereof. Consequently, the visitors/users of Eltrak.gr, using its services, undertake the relevant responsibility for the verification of the information provided.

LINKS WITH OTHER SITES

ELTRAK S.A. does not guarantee the availability, the contents the police of protection of the personal data, the quality and entirety of other web sites and pages to which it refers through ‘links’, hyperlinks or publicity banners. Thus, for any problem that may arise during the visit/use thereof, the user should go directly to the respective web sites and pages that have the entire responsibility for the services they provide. ELTRAK S.A. will in no case be considered as accepting the contents or the services of the websites and the pages to which it refers or as being connected with these in any other way.


Use of Cookies 

ELTRAK S.A. cannot use ‘cookies’ or similar electronic tools to collect information increasing the handiness of the service provided.

Protection of Personal Data 

The contracting parties declare that they comply with their obligations of the law 2472/97 on the Protection of the Person from the Process of Personal Character Data and the relevant decrees, directives and regulations of the Authority for the Protection of Personal Character Data and mainly their obligations as provided by Decree 50/2000 of this Authority for the processing of personal data aiming to the direct trade and publicity and the each time regulatory frame concerning the process of personal character data aiming to the promotion of sales. Contextually, it is declared by the ELTRAK S.A. and it is unconditionally accepted by the users that the relevant information, either provided by the user himself or collected by the procedure of ‘cookies’ or any electronic tools of the similar type, are stored in the servers of ELTRAK S.A. and/or the company Caterpillar Inc.


LAW APPLICABLE AND OTHER TERMS 

The above terms and conditions for the use of Eltrak.gr as well as any modification thereof are ruled and completed by the Greek law, the law of the European Union and the relative international conventions. Any provision of the above terms, contrary to the law, will cease ipso jure to be in force and is deleted here from and the other terms will continue to be in force unchanged. This is the entire agreement between ELTRAK S.A. and the visitor/user of the pages and services thereof and binds only them. No modification of these terms will be taken into consideration and will not be a part of this agreement if not explicitly expressed in writing and not incorporated in it.
